Welcome to the website of Fort Wayne Jewish Federation Inc. (“FWJF,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of fwjf.org and any related pages, forms, content, donation pages, event information, program information, newsletters, downloads, and other online services that link to these Terms.

By accessing or using our website, submitting a form, registering for a program, subscribing to our newsletter, or making a donation, you agree to these Terms. If you do not agree, please do not use the website.

1. About FWJF

Fort Wayne Jewish Federation Inc. is a nonprofit organization serving the greater Fort Wayne Jewish community through charitable, educational, cultural, community-building, and related programs.

2. Website Content

The content on this website is provided for general informational, charitable, educational, community, and program-related purposes. We try to keep information accurate and current, but we do not guarantee that all information is complete, current, error-free, or available at all times.

Program dates, event details, registration availability, donation campaign information, newsletter content, resources, and other website materials may change without notice.

3. Eligibility and Use of the Website

This website is intended for use by adults, parents or legal guardians, donors, volunteers, community members, and others interested in FWJF’s mission and programs.

Children under 13 should not submit personal information directly through the website. When information about a child is required for programs such as Camp Joe, that information must be submitted by a parent or legal guardian.

You agree not to use the website to:

  • Violate any applicable law or regulation.
  • Submit false, misleading, or unauthorized information.
  • Interfere with website security, operation, or availability.
  • Attempt to access systems, data, or accounts without authorization.
  • Upload or transmit viruses, malware, or harmful code.
  • Use website content in a way that infringes FWJF’s rights or the rights of others.

4. Donations

FWJF accepts charitable donations, including general fund donations, donations to specific funds or campaigns, honor gifts, memorial gifts, one-time gifts, and recurring gifts.

Online donations are processed through Bloomerang or other payment/donation service providers that may be used by FWJF from time to time. FWJF does not intentionally collect or store full payment card numbers through fwjf.org.

By making a donation, you represent that:

  • You are authorized to use the payment method provided.
  • The information you provide is accurate.
  • You understand that donations are charitable contributions to FWJF.
  • You agree to any applicable third-party payment processor terms.

5. No Refunds for Donations

All donations are final and nonrefundable.

FWJF does not provide refunds for donations, except where required by applicable law or where FWJF determines, in its sole discretion, that a transaction error, duplicate charge, or similar administrative issue requires correction.

6. Recurring Donations

If you set up a recurring donation, you authorize the applicable donation/payment processor to charge your selected payment method according to the recurring schedule you choose.

You are responsible for maintaining accurate payment information. You may request cancellation or changes to a recurring donation by contacting FWJF or using any available tools provided by the donation processor. Cancellation of a recurring donation applies prospectively and does not create a refund right for prior completed donations.

7. Restricted and Designated Gifts

If you designate a donation for a specific fund, campaign, program, tribute, memorial, or other stated purpose, FWJF will use reasonable efforts to honor that designation.

FWJF will not intentionally redirect a restricted or designated donation to an unrelated purpose without donor consent. If a designation cannot be honored because a campaign, fund, program, or purpose is unavailable, completed, overfunded, closed, or otherwise impracticable, FWJF may contact the donor to request written permission for an alternate use. If donor consent is not obtained, FWJF will handle the donation in accordance with applicable law and FWJF’s internal policies.

8. Tax Information

FWJF may provide donation acknowledgments or receipts where appropriate. Any statement about tax deductibility is provided for general informational purposes only and is not tax advice.

You are responsible for consulting your own tax advisor regarding the tax treatment of any donation.

9. Program, Event, and Camp Information

FWJF may provide information about programs, events, camp activities, community gatherings, educational opportunities, and related activities.

Program and event information may change due to scheduling, weather, venue availability, staffing, enrollment, safety considerations, or other operational needs. FWJF may update, postpone, modify, or cancel programs or events when necessary.

For Camp Joe or other child-related programs, a parent or legal guardian must complete required registration, emergency contact, health, medical, permission, payment, and release forms.

10. Health and Emergency Information

Some programs, including Camp Joe, may require health, allergy, medication, emergency contact, physician, insurance, or related information. This information should be submitted only through designated program forms or approved channels.

Do not submit sensitive medical information through the general website contact form unless specifically instructed by FWJF.

11. Photos, Videos, and Media

FWJF may take or use photos, videos, recordings, or other media from events, programs, or activities. For children’s programs, FWJF obtains parent or legal guardian media/photo releases where required by FWJF policy.

By attending an event or submitting a media release, you agree that FWJF may use approved photos, videos, or recordings for legitimate nonprofit, educational, archival, newsletter, website, social media, promotional, or community purposes, subject to the scope of any applicable consent or release.

To request removal of a specific photo or video, contact office@fwjf.org. FWJF will review requests in good faith, but removal may not always be possible where materials have already been printed, archived, distributed, or published by third parties.

12. Newsletter and Communications

If you subscribe to Chailights or other FWJF communications, you agree that FWJF may send you newsletters, updates, event information, campaign information, and related communications.

You may unsubscribe from marketing or newsletter emails by using the unsubscribe link in the email or by contacting us at office@fwjf.org.

Administrative, donation-related, registration-related, or transaction-related communications may still be sent when necessary.

13. User Submissions

When you submit information through our website, email, forms, registrations, downloads, or other communication channels, you agree that the information you provide is accurate and that you have the authority to submit it.

You retain ownership of your own information and materials. You grant FWJF permission to use submitted information as reasonably necessary to respond to your inquiry, process donations, manage registrations, administer programs, send communications, maintain records, and carry out FWJF’s nonprofit activities.

Do not submit confidential, sensitive, or personal information unless it is necessary for the relevant purpose and submitted through an appropriate channel.

14. Intellectual Property

The website and its content, including text, graphics, logos, photos, videos, design elements, downloadable materials, and other content, are owned by FWJF or used with permission, unless otherwise stated.

You may view, download, or print materials from the website for personal, noncommercial, educational, or community use, provided you do not remove copyright, trademark, attribution, or other proprietary notices.

You may not copy, reproduce, modify, distribute, sell, exploit, or use website content for commercial purposes without FWJF’s prior written permission.

15. Third-Party Links and Services

The website may link to or use third-party websites, services, platforms, donation processors, newsletter providers, analytics tools, embedded content, social media platforms, or external resources.

Third-party sites and services are not controlled by FWJF. We are not responsible for their content, availability, privacy practices, security practices, or terms. Your use of third-party services is subject to their own policies and terms.

16. Website Availability and Security

We use reasonable efforts to maintain the website, but we do not guarantee uninterrupted access, error-free operation, or complete security. The website may be unavailable from time to time for maintenance, updates, technical issues, or reasons outside our control.

You are responsible for your own device security, internet connection, and any information you choose to submit online.

17. Disclaimer of Warranties

The website and all content, materials, forms, links, and services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, FWJF disclaims all warranties, express or implied, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, non-infringement, and security.

18. Limitation of Liability

To the fullest extent permitted by law, FWJF and its officers, directors, employees, volunteers, representatives, contractors, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to your use of the website, donations, third-party services, website content, communications, or these Terms.

Nothing in these Terms limits liability that cannot be limited under applicable law.

19. Indemnification

You agree to indemnify and hold harmless FWJF and its officers, directors, employees, volunteers, representatives, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your violation of these Terms, misuse of the website, unauthorized submission of information, or violation of any law or third-party right.

20. Changes to These Terms

FWJF may update these Terms from time to time. When we do, we will update the effective date above. Your continued use of the website after changes are posted means you accept the updated Terms.

21. Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms, the website, or your use of the website shall be brought in the state or federal courts located in Indiana, unless applicable law requires otherwise.
